Le Pacs a 10 ans et séduit toujours plus d'hétéros
Depuis sa naissance en 1999, le succès du Pacs ne se dément pas... auprès des hétérosexuels. Environ 5% des pacsés seulement sont des couples gays ou lesbiens.Le 13 octobre 1999, le Pacs était définitivement adopté à l'Assemblée nationale. Dix années ont passé, et le succès du Pacte civil de solidarité ne se dément pas. Il est souscrit par de plus en plus de couples hétérosexuels, au point de devenir souvent une étape vers le mariage qu'il menaçait de détruire, selon ses détracteurs.
Si le nombre de mariage stagne autour de 270.000 depuis une dizaine d'années, le nombre de couple pacsés est en augmentation. En 2008, près de 145.000 couples ont souscrit ce "contrat conclu par deux personnes physiques majeures, de sexe différent ou de même sexe, pour organiser leur vie commune". C'est un chiffre en hausse de 43% par rapport à l'année précédente.

Ce succès du Pacs s'accompagne d'une évolution sensible du profil des pacsés. La proportion de couples du même sexe le souscrivant n'étant que de 5,62% l'an dernier, selon les chiffres de l'Institut national d'études démographiques (Ined). Elle était estimée à près de la moitié au démarrage du Pacs.
C'est cette image d'"union pour homosexuels" et de "sape de l'institution du mariage" qui avait conduit à une année de guérilla parlementaire avant son adoption définitive en octobre 2009.
2.161 amendements avaient été déposés par les anti-Pacs, emmenés par Christine Boutin, alors députée apparentée UDF. Brandissant une bible, elle s'était notamment illustrée par un discours fleuve de cinq heures et demie dans l'hémicycle contre un type d'union dans lequel la plupart des députés de droite voyaient "une atteinte à la protection de la famille et de l'enfant".
Des "fiançailles moins glamour"
La parution de la première annonce d'un Pacs entre deux hommes dans le carnet du Monde, le 10 décembre 1999, avait attiré l'attention. La tenue, ce mois-ci à Paris du deuxième "salon du mariage et du Pacs" atteste de sa banalisation auprès du grand public. "Cela devient de plus en plus des 'fiançailles moins glamour'", explique l'organisatrice du salon, Marie-Josèphe Cresson.
Cette banalisation a été accélérée par la modification du régime fiscal applicable aux Pacsés par la loi de finance de décembre 2005, qui a mis fin à la période de 3 ans avant une imposition commune et par la loi du 23 juin 2006, permettant aux partenaires de choisir la séparation de biens ou le régime de l'indivision. Nombre d'études et de témoignages attestent qu'il est devenu pour beaucoup "une étape vers le mariage".
Antony, jardinier, 38 ans et Géraldine, infographiste, 32 ans, se sont pacsés en juin dernier dans le Puy-de-Dôme, en présence de leur fils de 2 mois.
"Au départ c'était intéressé, pour les impôts, des histoires de succession, pour notre enfant, et puis on s'est pris au jeu et on s'est acheté des alliances qu'on est tout fiers de porter aujourd'hui. Le Pacs c'est pour nous une étape qui peut durer assez longtemps", expliquent-ils.
Plusieurs sortes de Pacsés
"Globalement il y a aujourd'hui plusieurs sortes de pacsés", selon Marion Leturcq, doctorante à l'Ecole d'économie de Paris, qui a travaillé sur le sujet.
Elle distingue "ceux qui, dans une perspective dynamique, commencent par se pacser pour se marier plus tard, ceux qui de toute façon ne se seraient pas mariés, pour qui c'est donc une sorte de 'concubinage avancé', et ceux qui se seraient mariés mais qui finalement se disent 'autant se pacser', voyant là une sorte de mariage moins conventionnel".
Et elle estime que globalement depuis 2005, 30% des pacsés ont été incités à le faire pour des raisons fiscales, même si d'autres raisons entraient aussi en jeu dans leur décision.

Depuis dix ans le nombre de Pacte civil de solidarité (Pacs) conclus n'a cessé d'augmenter passant de 22.108 en 2000 à 144.716 en 2008. Voici quelques chiffres sur son évolution depuis sa naissance en 1999.
Le nombre de Pacs conclus en un an est passé de 22.108 en 2000, première année complète, à 100.999 en 2007 et 144.716 en 2008 (43% de hausse annuelle), selon l'Institut national d'études démographiques (Ined). Dans la même période, le nombre de mariages, qui avait connu un pic en 2000 avec près de 298.000, est passé à 267.000 (chiffres provisoires) en 2008.
Les dissolutions de Pacs sont passées de 620 en 2000 à plus de 23.000 en 2008, le taux de dissolution (par rapport au nombre de pacs conclus) étant de 16% l'année dernière, tandis que les divorces passaient de près de 114.000 en 2000 à plus de 131.000 (chiffres provisoires) en 2007 (45,5%).
La part de Pacsconclus par des personnes du même sexe est passée de 42% en 1999 à 6% en 2008.
Si l'on ne tient compte que des Pacs conclus par des partenaires de sexe différent, il y a eu en 2008 un Pacs pour deux mariages.
L'âge moyen des pacsés est passé de 37,6 ans en 1999 à 31,5 ans en 2006.
Le taux annuel de Pacs conclus en France pour 10.000 habitants est passé de 3,7 en 2000 à 9,8 en 2005. Il reste très variable d'un département à l'autre, passant en 2005 de 4 pour le département ayant le taux le plus bas à 20 pour Paris qui fait figure d'exception. "The fact that they're still giving I.V. and things of that nature to him, he's just barely hanging in there," Woodson said, calling Chandler a game-time decision for Monday. "I don't know what he's going to feel like tomorrow. Hopefully, a miracle happens overnight and he's ready to play."

Davis said that his back stiffened up after a collision with Dwyane Wade and a couple of tough screens from the Heat. But he felt better on Sunday and plans to play in Game 2.
Still, the Knicks aren't likely to get 48 minutes out of Davis and back-up Mike Bibby. Shumpert filled in at point guard in those minutes that the real point guards weren't in the game. So on Monday, Woodson will need to find someone else to bring the ball up the floor. And that might have to be Carmelo Anthony.
This is all a bit reminiscent of last year, when the Knicks lost Chauncey Billups to a knee injury in Game 1 of their first round series with the Celtics. And then Amar'e Stoudemire injured his back in warmups before Game 2.
"It's tough, but I'm not one to make excuses," Woodson said. "We're going to have to play."
